1. About Pumpd
Pumpd is a digital booking platform operated by Berth Living Ltd (company registered in England & Wales). Pumpd provides software that enables marina residents and visiting vessels to request pump-out appointments at participating marinas. Pumpd is a booking intermediary only. We do not own, operate, maintain, or control any pump-out equipment.
Important: Pumpd is not responsible for the availability, condition, performance, or failure of any pump-out machine or equipment. All physical pump-out services are provided by the individual marina. Any queries about equipment, service quality, or availability should be directed to the marina directly.
2. Booking Approval
All pump-out booking requests are subject to approval by marina staff. Submitting a request does not guarantee a confirmed slot. The marina team will confirm or decline your request and you will be notified by email and, where enabled, push notification. Approval is at the sole discretion of the marina. Pumpd has no involvement in the approval decision.
3. Visitor Payments & the Role of Stripe
Visiting vessel bookings are subject to a fee set by the individual marina. Pumpd is not the merchant of record and does not collect, hold, or transmit any payment funds on its own account. All payments are processed by Stripe Payments UK Ltd, an independent payment processor regulated by the Financial Conduct Authority (FCA), and settle directly to the marina's bank account via Stripe Connect.
You will be directed to pay within 4 hours of your booking being approved. If payment is not received within this window your slot is automatically released and no further action is required.
Pumpd's role is limited to: presenting the marina's price, generating a checkout session with Stripe, recording the booking once Stripe confirms payment, and triggering refunds when staff cancel a confirmed booking. Pumpd never sees your card details, never holds your money, and is not a party to the payment contract between you, Stripe, and the marina.
By completing payment you agree to Stripe's terms of service as well as these terms. Any chargebacks, disputes, or card-related complaints must be raised with your card issuer or with Stripe in the first instance; Pumpd will support the marina's response but is not responsible for resolving disputes between you and your card issuer.
4. Refunds & Cancellations
All refunds are issued by the marina via Stripe; Pumpd never holds visitor funds and therefore never refunds them from its own account. Where a refund is due under the rules below, Pumpd's staff dashboard issues the Stripe refund automatically on the marina's behalf, returning the funds to your original payment method.
Equipment Failure or Marina Cancellation
If a confirmed, paid booking is cancelled by the marina due to equipment failure, emergency maintenance, or circumstances outside the guest's control, a full refund is issued to the original payment method automatically. Refunds typically appear within 5-10 business days depending on your bank.
No-Shows
If you do not attend your booked pump-out slot, no refund is issued for visitor (paid) bookings. Repeated no-shows may result in your access to the booking service being suspended at the marina's discretion.
Late Cancellations
Cancellations made less than 30 minutes before the booked start time cannot be processed online. Please contact the marina directly. For visitor (paid) bookings cancelled with less than 30 minutes' notice, no refund is issued.
Pricing changes after booking
The price displayed at the time you book is the price you pay; price changes the marina makes later do not retroactively apply to existing bookings. The amount shown at checkout includes a small uplift on the marina's net price to cover Stripe's card-processing fee, so the marina receives the amount it set regardless of card type.
Resident (berth-holder) bookings are complimentary and carry no charge. Cancellations for resident bookings with more than 30 minutes' notice can be made via the dashboard at any time.
5. Operating Hours & Availability
Pump-out services are available during marina opening hours only. Opening times, available days, and slot capacity are set by the marina and are subject to change without notice, for example due to seasonal adjustments, public holidays, or equipment maintenance. Always check your confirmation email for your confirmed slot details. Neither Pumpd nor the marina accepts liability for wasted journeys where hours have changed after your booking was confirmed.
6. Use of Service
You agree to use the Pumpd booking platform only for legitimate pump-out booking purposes. Pump-out equipment must be used in accordance with instructions provided by marina staff. Users are responsible for any damage caused by misuse of the equipment. The marina reserves the right to refuse service to any individual at its discretion. Pumpd reserves the right to suspend or terminate access to the platform for any user who abuses the service or violates these terms.
7. Data Protection & Privacy (UK GDPR)
Berth Living Ltd is the Data Controller for personal data processed through the Pumpd platform. We process your data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.
What data we collect
- Name, email address, and phone number
- Vessel name and berth number (where applicable)
- Booking history (date, time, status)
- Push notification subscription tokens (residents only)
- IP address and browser information (server logs)
Legal basis for processing
- Contract performance, to deliver the booking service you have requested
- Legitimate interests, to operate, improve, and secure the platform
- Legal obligation, to comply with applicable laws, including financial record-keeping
Data storage & processors
Booking and account data is stored in a cloud database hosted within the European Economic Area (EEA). Data is retained for the duration of your marina residency plus a rolling 12-month period after your account is deactivated, after which it is permanently deleted.
We use the following sub-processors, each of whom is bound by appropriate data protection agreements:
- Resend, transactional email delivery
- Stripe, payment processing (visitor bookings only; card data never touches our servers)
- Vercel, application hosting (EEA/UK data residency)
We do not sell, rent, or share your personal data with third parties for marketing or profiling purposes.
Your rights
Under UK GDPR you have the following rights regarding your personal data:
- Right of access, request a copy of the data we hold about you
- Right to rectification, ask us to correct inaccurate data
- Right to erasure, request deletion of your data (subject to legal retention obligations)
- Right to restrict processing, ask us to limit how we use your data
- Right to data portability, receive your data in a machine-readable format
- Right to object, object to processing based on legitimate interests
To exercise any of these rights, contact us at hello@pumpd.uk. We will respond within 30 days. You also have the right to lodge a complaint with the Information Commissioner's Office (ICO) at ico.org.uk.
8. Limitation of Liability
Berth Living Ltd (Pumpd) provides a booking management platform only. We are not liable for:
- The availability, condition, or performance of any pump-out equipment
- Any damage to vessels or property arising from the use of marina equipment
- Delays, cancellations, or changes to the booking schedule made by the marina
- Loss of income or consequential loss of any kind arising from a booking being unavailable
- Service interruptions caused by third-party infrastructure (internet, hosting, payment processors)
To the fullest extent permitted by law, our total liability to any user in connection with these terms shall not exceed the amount paid for the relevant booking. Nothing in these terms limits or excludes liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation.

These terms are informed by and comply with the following legislation:

- Data Protection Act 2018
- Consumer Rights Act 2015
- Electronic Commerce (EC Directive) Regulations 2002
- Privacy and Electronic Communications Regulations 2003 (PECR)
- Harbour, Docks and Piers Clauses Act 1847 (as applicable to marina operators)
10. Changes to These Terms
We may update these terms from time to time. The date at the top of this page will always reflect the most recent update. Where changes are material, we will notify registered users by email. Continued use of the platform after changes are published constitutes acceptance of the updated terms.
11. Governing Law
These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
